Dada Viajes - Daniel Galecio Terms and Conditions

These Terms and Conditions Agreement govern the relationship between Dada Viajes, hereinafter referred to as "the Agency", and the client, hereinafter referred to as "the Traveler". By using the services provided by the Agency, the Traveler agrees to be bound by the terms and conditions outlined below in the moment the booking is confirmed with automatic consent and approval once the Final Proforma is sent and the traveler agrees with the payment.

1. Booking and Reservations:

• All bookings and reservations are subject to availability and confirmation by the Agency.
• The Traveler must provide accurate and complete information at the time of booking.

2. Payments and Pricing:

• Prices are quoted in MXN, USD or CAD, and are subject to change without notice until full payment is received.
• Payment schedules and methods will be communicated at the time of booking.
• Any additional charges incurred during the trip must be settled by the Traveler.

3. Cancellations and Refunds:

• Cancellation policies vary by destination, service provider, and type of booking. These will be provided at the time of booking.
• The Agency reserves the right to charge cancellation fees.
• Refund eligibility is subject to the policies of the respective service providers.

4. Travel Documents and Insurance:

• It is the Traveler's responsibility to ensure they possess the necessary passports, visas, and other travel documents required for their trip.
• Travel insurance is strongly recommended and can be arranged through the Agency upon request.

5. Changes to Itinerary:

• The Agency reserves the right to make changes to the itinerary due to unforeseen circumstances, including but not limited to weather conditions, strikes, or changes by service providers.

6. Health and Safety:

• The Traveler is responsible for ensuring they are in good health and fit for travel.
• The Agency is not liable for any health-related issues or accidents that occur during the trip.

7. Liability:

• The Agency acts as an intermediary between the Traveler and service providers (e.g., airlines, hotels, tour operators, train operators, translators, agents, shared space, tours, parties, weddings, meals and events) and is not liable for any deficiencies in their services.
• The Agency is not responsible for any loss, injury, or damage to the Traveler or their belongings.

8. Force Majeure:

• The Agency shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control.

9. Governing Law and Jurisdiction:

• This Agreement shall be governed by and construed in accordance with the laws of Ecuador, Mexico, the United States or Canada (depending where the service is provided and the confirmation is made, to be confirmed in the service contract). Any disputes shall be subject to the exclusive jurisdiction of the courts of Ecuador.

10. Entire Agreement:

• This Agreement constitutes the entire understanding between the Agency and the Traveler, and supersedes all prior agreements or understandings, whether written or verbal.
• The traveler aknowledge that Dada Viajes - Daniel Galecio is just an intermediate between the client and the service provider. Any problem or inconvenient, disagreement or dispute would be done directly passed to the service provider. 

By booking a trip with Dada Viajes - Daniel Galecio the Traveler acknowledges that they have read, understood, and agreed to these terms and conditions.
